To what extent are private bodies such as landowners, banks, medical
aid schemes and companies bound to respect human rights? This question
lies at the heart of the transformation of South African society and
underlies many contemporary South African debates related to land
reform, the national health insurance scheme, affordable housing for the
poor, and fair employment conditions for workers.
Justice Mbuyiseli Madlanga of the Constitutional Court will address
the theme of The Human Rights Duties of Companies and other Private
Actors in South Africa in the 2018 Annual Human Rights Lecture of the
Faculty of Law and the Human Rights Chair, Prof Sandra Liebenberg, of
the University of Stellenbosch Law Faculty. The lecture marks the
University of Stellenbosch centenary along with the centenary of the
birth of Nelson Mandela.
Justice Madlanga is a jurist with a distinguished career as an
academic, advocate and judge. He has appeared as an advocate in a number
of landmark cases, and has held a range of positions including
Chairperson of the Exchange Control Amnesty Unit, Chief Evidence Leader
of the Marikana Commission of Enquiry, Deputy Chairperson of the
Competition Tribunal, and member of the Judicial Services Commission.
Appointed as justice of the South African Constitutional Court in 2013,
he has authored a number of significant judgments related to
constitutional law and human rights. He holds an honorary doctorate from
Walter Sisulu University, and is Editor-in-Chief of the South African
Judicial Education Journal.
